These Terms of Sale govern the sale of products on the website TharryStore, operated by Temam Arezki, Entrepreneur Individuel (EI), trading under the commercial name ATES MARKET. By placing an order on this website, you fully accept these Terms of Sale.

3. Products

All products available on TharryStore are described and presented as accurately as possible. Photographs are illustrative; minor variations in colour, finish or natural materials may occur. This does not affect your statutory rights under Article 9 below.

We are an online-only retailer. Our products are sourced from third-party suppliers and dispatched to you after your order is confirmed.

4. Prices

All prices are displayed in Euros (€), including taxes (TTC). We may modify prices at any time, but the price charged will always be the one displayed at the time of order confirmation.

5. Orders

Any order placed on this website implies full acceptance of these Terms of Sale. An order is considered confirmed once payment has been successfully received.

6. Payment

Payments are processed securely through the payment methods available on the website: credit and debit cards (Visa, Mastercard, American Express, Cartes Bancaires), PayPal, Klarna, Apple Pay and Shop Pay. The methods available to you are displayed at checkout.

7. Shipping & Delivery

Products are shipped to the address provided by the customer at checkout. We currently ship to France only.

Orders are processed within 1 to 2 business days after payment confirmation. Estimated delivery time: 5 to 8 business days after processing — approximately 6 to 10 business days in total.

Shipping is free on all orders within France. There are no additional shipping charges at checkout, and no minimum order value is required.

In accordance with Article L216-4 of the French Consumer Code, the risk of loss or damage passes to you only when you or a third party you designate takes physical possession of the goods. If your order is delayed, lost or damaged in transit, we remain responsible and will arrange a replacement or refund. If we have not delivered by the date indicated, or within 30 days where no date was given, you may cancel the order and obtain a full refund (Articles L216-6 and L216-7).

8. Right of Withdrawal (14 Days)

In accordance with Article L221-18 of the French Consumer Code, you have the right to withdraw from your purchase within 14 days of receiving your order, without providing any reason and without penalty.

To exercise this right, inform us by a clear statement (email to tharrystore@gmail.com). A model withdrawal form is available on our Return & Refund Policy page, but you are not obliged to use it. This statutory right is separate from, and not limited by, any commercial return policy on this site.

Pursuant to Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to sealed goods which are not suitable for return for health or hygiene reasons and were unsealed after delivery (this may apply to earrings and other pierced jewellery).

9. Legal Guarantee of Conformity & Hidden Defects

Independently of the commercial return policy, all products benefit from the following statutory guarantees under French law:

• Legal guarantee of conformity (Articles L217-3 to L217-20 of the French Consumer Code): for 2 years from delivery, you may request repair, replacement, or a refund if the product is defective or does not conform to the contract, free of charge.
• Guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code): you may return a product and choose between a refund or a price reduction if it has a hidden defect that makes it unfit for its intended use.

10. Returns (Commercial Policy)

Independently of your statutory rights above, to be eligible for our commercial return policy, the product must be unused, in its original condition, and in its original packaging. Return shipping costs are the responsibility of the customer.

Please contact us before sending anything back. Our registered address is not a returns address — we will provide the correct return address in writing once your return is confirmed.

11. Refunds

If the right of withdrawal is exercised, we refund you within 14 days of receiving your withdrawal notice, using the original payment method. As permitted by Article L221-24 of the French Consumer Code, we may wait until we have received the item back, or until you provide proof that you have sent it — whichever comes first. No fee is charged for the refund.

12. Damaged or Defective Items

If your item arrives damaged or defective, please tell us as soon as you can — ideally within 48 hours of delivery — and send clear photos or videos. This is a request for prompt notification, not a deadline: reporting later does not affect your statutory rights, which last 2 years from delivery (Article 9 above). We will offer a replacement or a full refund, free of charge.

13. Liability

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under mandatory French law, including our obligations regarding delivery, conformity and hidden defects.

14. Customer Service & Dispute Resolution

We aim to resolve any issue directly and amicably. Contact us at tharrystore@gmail.com or on +33 6 18 23 44 19; we reply within 1 to 2 business days.

If no amicable solution is found, you may refer the matter free of charge to a consumer mediator, and you may also use the European Online Dispute Resolution platform. These remedies are in addition to, and do not replace, your right to bring proceedings before the courts.

15. Governing Law & Jurisdiction

These Terms of Sale are governed by French law. As a consumer, you retain the protection of the mandatory provisions of the law of your country of residence and may bring proceedings before the courts of your place of domicile.
